[vc_row][vc_column][vc_column_text]These Terms of Use are made and entered into by and between you and Sporting Moreland Inc Trading as Glenroy Lions ABN: 56 686 175 992 (herein referred to as “Glenroy Lions”, “We”, “Us”, or “Our”), currently located at Wallace Reserve, Glenroy. “You,” or “your” refers to you, a user of the site, a purchaser on the site, a parent or legal guardian of a player (under the age of 18) within the program, or a player over the age of 18 who is visiting.

By accessing and/or using glenroylionsfc.com (“Glenroy Lions’ Website”, “Site” or “Website”), you are expressly agreeing to comply with and be bound by the following Terms of Use as well as all applicable laws and regulations.

  1. Legal Agreement
    1. These Terms and Conditions all set forth the entire terms and conditions applicable to You
    2. These Terms and Conditions constitute a binding and enforceable legal contract between Glenroy Lions and You – so please read them carefully.
    3. You purchase any products or services from Glenroy Lions Website only if you fully agree to these Terms and Conditions in their entirety.
    4. If you do not read, fully understand nor agree to these Terms and Conditions in full, then You must leave the Glenroy Lions Website immediately and cancel any current service agreements with Glenroy Lions immediately.
    5. These terms and conditions are subject to change without notice, from time to time, at Glenroy Lions’ sole discretion. The updated Terms and Conditions will be placed on the Glenroy Lions Website at the time of alteration.
  2. Our obligations
    1. Glenroy Lions runs training programs 5 days a week, 48 weeks a year (“Training”) at Glenroy Lions’ home ground, situated at Wallace Reserve, 123 Justin Avenue, Glenroy, Melbourne Victoria (“Glenroy Lions Ground”).
    2. Glenroy Lions runs a community soccer skills program that is now internationally recognized by pro teams like Olympiacos FC.
    3. Glenroy Lions’ program international recognition is by recognition only and not by any standing agreement, affiliation or other commercial agreement.
    4. By offering training 5 days a week, Glenroy Lions will ensure that the player is exposed to all aspects required to reach their full potential.
    5. Glenroy Lions train You until you have reached your maximum potential in all areas of soccer.
    6. Care and caution by all Glenroy Lions staff is taken at all times, but as of mishap, Glenroy Lions cannot accept liability for any injury that may occur whilst participating in one of our programs.
    7. At least one Glenroy Lions staff member at each location has a successful working with children check.
    8. The recognition of the skills program allows the players training at Glenroy Lions via the coaches who can now be trusted to play the role of Euro scouts and assessors for Euro scouts.
    9. Glenroy Lions will provide every opportunity to the player to obtain the knowledge and fitness required to obtain a positive outcome at the European trials.
  3. Your obligations
    You represent and warrant that:

    1. If You are at least eighteen (18) years of age, and possess the legal authority, right and freedom to enter into these Terms and Conditions to form a binding agreement between Yourself and Glenroy Lions;
    2. If you are under eighteen (18) years of age, You are represented by a parent/guardian, who will bring the child to the Glenroy Lions Ground, remain there throughout the duration of the training session and take the child safely away from the premises at the end of the training session. You have responsibility for the care of Your child whilst they are at Glenroy Lions.
    3. You are currently a resident of Australia;
    4. You are in a good physical condition, not suffering from any heart, lung or other bodily ailment and is in all respects physically fit to engage in the services provided by Us.
  4. Unable to provide service
    1. If there is an issue with the location and Glenroy Lions is unable to run the program for 14 consecutive days in a calendar month, Glenroy Lions may decide to adjust the direct debit.
    2. Any decision is final and non-disputable by any party.
  5. Acceptable Use Policy
    1. Any and all content which You contribute to or send via the Website must:
      1. Be accurate (where they state facts);
      2. Be genuinely held (where opinions are stated); and
      3. Comply with the applicable laws in Australia.
    2. Any and all content which you contribute to or send via the Website must not:
      1. Be unlawful, threatening, defamatory, libelous, obscene, harassing and/or harmful to the Glenroy Lions or any third party;
      2. Infringe intellectual property rights of any third party
      3. Be contributed or sent for commercial gain.
    3. Internet Security
      1. Internet transmissions are never completely private or secure and there is a risk, therefore, that any message or information you send to us from the Website may be intercepted and potentially read by others. We will have no liability in respect of any transmissions you send to us and you do so entirely at your own risk.
    4. Areas of the Website with Restricted Access
      1. Website users may be offered the opportunity to subscribe and/or register to receive additional restricted access to the Website or information. If we accept Your registration, it is for a single user only. Glenroy Lions does not permit you to share Your user name and password with any other person nor with multiple users on a network. The responsibility for the security of any passwords issued by Us or chosen by You rests with You.
    5. Registrations and Payments
      1. General
        1. The Player’s place is not secured until fees are paid in full.
        2. An annual registration fee must be prior to commencement of training. When paying the signup fee, the Player will receive a free kit which includes:
          1. Shirt
          2. Shorts
          3. Socks
          4. Bag
          5. Tracksuit
        3. 5 Day a week, all year training
          1. You agree to be automatically charged every month in advance for the training sessions. Should you wish to cancel our services, you will need to send an email to [email protected] clearly stating your decision to stop the enrolments, together with a reason. Upon receiving this email, your future direct debit payments will be ceased. The enrolment will remain active until the completion of the current direct debit payment. No refunds will be given for the remaining paid sessions.
          2. Failure to attend any training session does not signify or imply notification to cancel this agreement. Glenroy Lions is still required to provide the service as well as retain Your allocated space.
          3. Debit payments
            1. If you are enrolled for 5 days a week all year training, You authorise Glenroy Lions to make periodic debits.
            2. You acknowledge that PayPal is acting as a Direct Debit Agent for the Glenroy Lions and that Glenroy Lions.
            3. You acknowledge that the debit amount will be debited from Your account according to the terms and conditions of Your agreement with Glenroy Lions.
            4. You acknowledge that bank account and/or credit card details have been verified against a recent bank statement to ensure accuracy of the details provided and We will contact You if We are uncertain of the accuracy of these details.
            5. You acknowledge that is Your responsibility to ensure that there are sufficient cleared funds in the nominated account by the due date to enable the direct debit to be honoured on the debit date. Direct debits normally occur overnight, however transactions can take up to three (3) business days depending on the financial institution. Accordingly, You acknowledge and agree that sufficient funds will remain in the nominated account until the direct debit amount has been debited from the account and that if there are insufficient funds available, You agree that Glenroy Lions will not be held responsible for any fees and charges that may be charged by either Your or its financial institution.
            6. You acknowledge that there may be a delay in processing the debit if:
              1. there is a public or bank holiday on the day of the debit, or any day after the debit date;
              2. a payment request is received by Glenroy Lions on a day that is not a banking business day;
              3. a payment request is received after normal banking cut off times, being 3:00pm AEST time, Monday to Friday.
            7. Any payments that fall due on any of the above will be processed on the next business day.
            8. You acknowledge that Glenroy Lions is to provide at least 14 days’ notice if it proposes to vary any of the terms and conditions of the Direct Debit Request or this DDR Service Agreement including varying any of the terms of the debit arrangements between You and Glenroy Lions.
            9. You acknowledge that any disputed debit payments will be directed to Glenroy Lions.
            10. You acknowledge that if a debit is returned by Your financial institution as unpaid, a failed payment fee is payable to Glenroy Lions. You will also be responsible for any fees and charges applied by Your financial institution for each unsuccessful debit attempt together with any collection fees, including but not limited to any solicitor fees and/or collection agent fee as may be incurred by Glenroy Lions.
            11. You authorise Glenroy Lions to attempt to re-process any unsuccessful payments as advised by the Soccer Club.
            12. You acknowledge that “Paypal” will appear as the merchant for all payments to Glenroy Lions.
            13. Other than as provided in this Agreement or the Glenroy Lions Privacy Policy, Paypal will store your information about your nominated account at the financial institution private and confidential.
            14. You authorise Glenroy Lions to verify and/or correct, if necessary, details of Your account with Your financial institution; and Your financial institution to release information allowing Glenroy Lions to verify Your account details.
          4. Failed direct debit payments
            1. In order to ensure the players position remains secured, please ensure there are funds available to prevent a failed direct debit payment.
            2. Should a failed direct debit payment occur, you will need to contact Glenroy Lions on (03) 8592 0161 to arrange a new date to re-attempt the debit.
            3. If no new arrangement has been made, Glenroy Lions will automatically attempt another debit 7 days after the failed debit payment.
            4. Failure to resolve within 7 business days of the 2nd failed direct debit payment, Glenroy Lions reserves the right to cancel Your enrollment, and allow another player to take the position.

 

  1. Cancellation of Session
    1. In accordance to Our duty of care, Glenroy Lions reserves the right to cancel a session, if deemed unsafe to continue and at any time without notice.
  2. Refund
    1. In order for Your request for a refund to be considered, You must submit your request to Glenroy Lions no later than 14 days after the payment was made. A failure to report this request within this allocated time frame will automatically result in the request being invalid and a refund will not be given.
    2. Submission of the request of refund must be made in writing by sending an email to [email protected]. In order to streamline the process, we request You provide all supporting documentation to assist with the investigation of the refund request.
    3. Glenroy Lions reserves the right to determine whether Your request to obtain a refund is viable.
    4. Any refund decision is final and non-disputable by any party.
  3. Suspension of services
    1. Glenroy Lions does not offer a suspension of services for any reason. As our program has now become internationally recognized, it is Our responsibility to ensure that we make Our services accessible to as many players as possible.
  4. Cancellation of services
    1. Cancellation of services will occur, but not limited to, the following reasons:
      1. Breach of the code of conduct by a player or parent/guardian;
      2. Failed direct debit payments;
    2. Upon cancellation of services, We have completed out obligation to provide the player every chance learn from Our internationally recognized program. You immediately indemnify Us for any for any future events that may arise during the remainder of Your sporting career.
    3. Upon cancellation, our services will cease to You, effective immediately.
    4. To cover the cost required to bring a player to replace You, no refunds will be given for the remaining unused direct debit debit payments
  5. Positions On Hold
    1. Glenroy Lions does not reserve positions for any players for any reason. The program at Glenroy Lions is highly sought after and it’s an obligation for Us to provide the opportunity to as many Players as possible.
  6. Indemnity
    During and after the training, You indemnify Glenroy Lions for:

    1. Not successfully obtaining a trial with any other club;
    2. Not successfully entering another club, whether local or abroad;
    3. Accidental death;
    4. Any personal injury which may be sustained whilst training;
    5. Loss, through theft or otherwise and damage to personal property and effects; either before, during or after commencement of training classes with Glenroy Lions
    6. Physical contact will be used by other Players and authorised individuals as part of the training instruction. The Player has been advised of such fact and gives full consent to any physical contact as may be required or customary to football training.
    7. In recognition of the possibility of accident or injury connected with football training, the Player waives any right or cause of action of any kind arising as the result of such activity from which any liability may or could accrue to the Us, it’s officers, coaches or employees.
  7. Program Sessions
    1. Glenroy Lions cannot be held responsible for any loss or damage to any personal belongings while attending one of our coaching/education programs
    2. Any medical conditions that a participant may have must be fully disclosed to Glenroy Lions in the registration details
    3. Any student or potential student must inform the Director(s) if a student is/was committed for a criminal offence.
